Terms of Use and Privacy Collection Statement
Participation
Your participation in a fundraising event or activity for the benefit of Royal Far West (RFW) is at your own risk and is subject to any other conditions provided to you.
It is your responsibility to comply with all legal requirements relating to the fundraising event or activity, including your obligations under the relevant charitable fundraising legislation in your state or territory (e.g. in NSW, the Charitable Fundraising Act 1991 applies) and any applicable Council requirements. You are responsible for obtaining your own insurance, as appropriate (note: if fundraising is undertaken on RFW premises, insurance is a prerequisite).
Use of the Platform
Royal Far West’s Community Fundraising Platform (the Platform) is operated and administered by Funraisin. Our contract with Funraisin requires Funraisin to comply with relevant laws, including the Privacy Act 1988, and that your personal information is held securely and only used for authorised purposes, including processing funds relating to the fundraising activity or event in which you have agreed to participate.
When you access and use the Platform you warrant that you agree to these Terms. If you do not accept these Terms you may not use or continue to use the Platform. RFW may change or update these Terms from time to time. You are responsible for ensuring you continue to agree to these and any relevant Terms posted on the Platform at any time.
Your Privacy
The privacy of our supporters is a top priority for Royal Far West.
Royal Far West is bound by, and complies with, the Privacy Act 1988 and the Australian Privacy Principles (APPs), as well as RFW’s own Privacy Policy.
Royal Far West and/or people authorised by it may gather and process the information:
- which you may provide when accessing the Platform, such as your name, address, email address and other personal information;
- posted by you on the Platform; and
- regarding the way in which you use the Platform including, without limitation, information acquired through the use of cookies programmed during the accessing of the Platform.
We will only collect personal information where it is necessary for us to perform one or more of our functions or activities or for any other purpose you have authorised.
Parental consent
Any person under the age of 16 conducting a fundraising event or activity must be appropriately supervised by an adult. Where a child is under the age of 12, he or she must only participate under the direct permission and supervision of their parent or guardian.
Use of Material on the Platform
All information, including intellectual property rights, contained on the Platform (including text, images, graphics, artwork, audio and video) is owned by RFW. You are not authorised to reproduce, distribute, retransmit, upload, repost or otherwise use material for any purpose, unless authorised in writing by RFW.
Links
The Platform may contain links to other websites that are owned and operated by third parties and which are not under the control of RFW. The existence of a link to other sites does not imply any endorsement by RFW of the linked site and RFW is not responsible for the material contained on those linked sites.
Conduct
You will not use the Platform to:
- Upload, post, email, transmit or otherwise make available any material that is abusive, harassing, obscene, defamatory or is otherwise offensive or inappropriate;
- Impersonate any person or entity, including, but not limited to, staff members and volunteers of Royal Far West and their affiliates;
- Collect or store personal information about other users of this Platform;
- Upload, post, email, transmit or otherwise make available any unsolicited material or advertising.
Removal of Information
Royal Far West reserves the right to remove any material and/or information at any time without giving any explanation or justification.
Royal Far West may:
- Monitor, retain or disclose any information on the Platform when necessary in accordance with applicable laws;
- Screen, block or remove any content posted or uploaded on the Platform;
- Suspend access to the Platform without notice to you if you fail to comply with these Terms.
Use of your name and content
By registering your participation in a RFW fundraising event or activity, you consent to the free use of your name and content and/or pictures published on this Platform in any form whatsoever, including broadcast, telecast or print by RFW.
Disclaimer and Indemnity
To the extent permitted by law, RFW and its officers, employees and agents are not liable for any damages, costs or losses or of any kind, which you may incur, arising either directly or indirectly from your access or use of the Platform (including the defamatory, offensive or illegal conduct of any other user of the Platform whether caused through negligence of RFW, its employees or independent contractors, or any other cause) or the conduct of your fundraising activity.
You indemnify and will keep indemnified RFW and its officers, employees and agents (“the indemnified”) from and against any loss (including reasonable legal costs and expenses) or liability incurred by any of the indemnified arising from any claim, demand or proceeding by any person against any of the indemnified where such loss or liability arose out of or in connection with any breach of these Terms by you; and/or the publication of or distribution of the material and/or information supplied by you.
Governing Law and Jurisdiction
The laws of New South Wales and the Commonwealth of Australia (as applicable) govern these Terms and any other additional terms which govern your use of and access to this Platform. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any court hearing appeals from those courts.
